Terms of Sale
1. About these terms
These terms apply to every order placed on this website. Staying Active is run by Eos Active, a company registered in England and Wales (company number 14082845), of 16 Front Street, Monkseaton, NE25 8DF. In these terms “we” and “us” means Eos Active, and “you” means the person placing the order. Please read them, with our Delivery & returns page, before you order. Nothing in these terms affects your statutory rights.
2. Your order
When you place an order we email you to confirm we have received it. Our contract with you starts when we accept your order, which we confirm by email. We may decline an order, for example if an item is unavailable or a price was shown in error; if we do, we will tell you and refund anything you have paid.
3. Prices and payment
Prices are in pounds sterling and include VAT where it applies. Delivery charges, if any, are shown at checkout before you pay. Payment is taken by card through a secure payment provider when you place your order; we never see or store your full card details.
4. Delivery
We deliver to UK addresses. Delivery options, charges and timescales are set out on our Delivery & returns page. The items become your responsibility once they are delivered to the address you gave us.
5. Your right to cancel
You may cancel your order for any reason within 14 days of the day you receive it, and our returns window described on the Delivery & returns page may give you longer. Items must be returned as set out there. For reasons of health protection and hygiene, this right does not apply to sealed goods that have been unsealed after delivery, such as supports and braces that have been worn or supplements that have been opened.
6. Faulty or incorrect items
If an item is faulty, damaged or not as described, please contact us as soon as you can. You are entitled to a repair, replacement or refund under the Consumer Rights Act 2015, and we will cover the cost of returning it.
7. Rentals
Where an item is rented rather than sold, the rental period, delivery and collection arrangements shown on the product page and in your order confirmation also form part of these terms. Rented equipment remains our property or the property of our supplier and must be returned at the end of the rental period in the condition it was supplied, allowing for normal use.
8. Health information
Product descriptions and articles on this website are general information and are not a substitute for advice from a clinician who has assessed you. If you are unsure whether a product is right for you, please speak to a clinician before you buy.
9. Our responsibility to you
We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, or for losses to a business. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.

11. Changes to these terms
We may update these terms from time to time. The terms that apply to your order are the ones shown on this website when you placed it.
12. Law
These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland you may also bring proceedings in your local courts.
